Due to HR etc, I probably should just preface this story by asking the question, is it illegal to sleep in your car and does it make a difference if you’re drunk? Simple.
It is completely legal to sleep in your car, provided you are parked in a safe and legal place. That fortunately is the easy part, when alcohol is involved it is a little trickier.
Today I learnt that it is only legal to sleep in your car whilst drunk under a few provisos:
– You must not be sleeping in the driver’s seat.
– You must not be in possession of the keys to the vehicle.
So in essence it is a little tricky. If you sleep on the back seat and leave the keys with a friend then you can get away with it, but if you are in the driver seat or have the keys on you then you can be prosecuted for drink driving.
Kids, stay safe – just find a space on a friends floor or get a hotel. It’s not worth going to jail for.
